I. Selecting the Work

Fill out the form and submit your order.

II. Order confirmation and payment

After submitting, you will receive a confirmation email also containing payment information.

III. Receiving of Goods

You can pick up the goods in person at the artist’s studio at the Žižkov Freight Railway Station. If you have chosen another method of delivery, you will receive the goods immediately after the payment has been received by the delivery company of your choice (several delivery methods are available).

Within 14 days of receiving your goods you have the option to return. If you have decided to return please write to:

GENERAL TERMS AND CONDITIONS

The general terms and conditions (GTC) of the Petr Písařík e-shop of original art pieces is run from the internet address www.petrpisarik.com. The complaints department is an integral part of this.

1.  Basic Terms

1.1. The GTC regulates the relations between the contracting parties for the purchase contract with one side being formed by: Veronika Slámová, Luka pod Medníkem 17, Jílové u Prahy, 254 01, IČ: 09493247, the address for electronic communication is:

(hereinafter referred to as the “Seller”) and on the other side the buyer, who may be a consumer or a business (hereinafter referred to as the “Buyer”.

1.2. By placing an order, the Buyer confirms that they have read the GTC and agrees to them. The Seller shall deliver to the Buyer a copy of the GTC attached to the order confirmation to the Buyer’s email address provided by the Buyer in their order.

2. Purchase Contract

2.1. The proposal to conclude a purchase contract from the Seller’s side is the placement of the offered goods on the website of the online store. The purchase contract itself is formed when the Buyer sends an order and the Seller accepts the order.

2.2. The Seller shall promptly confirm the receipt of the Buyer’s order by email to the Buyer’s email address specified by the Buyer in the order with the following being attached to the confirmation: GTC, description of the goods and instructions for packing.

3. Withdrawal from Contract

The Buyer has the right to withdraw from the contract without any given reason and without any kind of penalty within 14 days of receiving the goods. The Buyer shall bear the costs of returning the goods in accordance with the Civil Code. The Seller has the

right to withdraw from the contract for lawful reasons.

For a successful and trouble-free return, we ask you to follow the following procedure:

1.Contact us with a request to withdraw from the purchase contract, indicating the order/invoice number, date of purchase and receiving of goods. After checking this request, we will ask you to send a request in writing for the withdrawal from the purchase contract and ask for the goods to be returned.

2. Send the goods themselves by registered and insured mail to our billing address. We are not responsible for any loss or damage to the parcel during transit back. The goods must be complete (including all documents and accessories), unused, undamaged and packaged in such a way that the original packaging has not been damaged during transit. Do not send any goods that require us to pay costs of shipping or delivery. Such goods will not be accepted.

4. Personal Data

4.1. All data received by the Seller in connection with the Purchase Contract is confidential and will only be used to carry out the Purchase contract and, where applicable, to send information about the Seller’s goods and services. The data will not be disclosed or made available to any third party, except for those involved in the delivery of the goods to the Buyer and in the payment process.

4.2. The Buyer consents to the Seller in the collecting and processing of personal data for the purpose of fulfilling the subject matter of the Purchase Contract and consents to the Seller sending information about the Seller’s goods or services to the email address provided by the Buyer.

5. Price of Goods

5.1.Prices are contractual. The prices listed in the e-shop are always current and valid.

5.2. Shipping costs according to the price list will be added to the price of the Buyer’s goods. This will be in accordance with the price list of the chosen carrier (the Buyer chooses the shipping price when selecting the goods on the e-shop according to the goods’ size). The Buyer may also pay for the price of shipping arranged by themselves. The Buyer can find the current list of prices for shipping on the e-shop website. (7. Delivery conditions)

5.3. The final price including all taxes and the cost of shipping will be provided to the Buyer in the recapitulation of the Buyer’s order.

7.  Delivery Conditions

7.1. The Seller shall deliver the goods to the Buyer by means of a transport service or the Buyer shall choose his own transport.

7.2.Delivery times are approximate and the Seller is not bound by them, as delivery is usually dependent on the deadlines of individual carriers. The delivery period is fulfilled on the date of the dispatch of the consignment, on the date of removal of the goods from the Seller’s warehouse or on the date of preparation of the goods for acceptance by the Buyer or their authorized carrier. Delivery times shall be extended in the event of unexpected circumstances beyond the Seller’s control, such as unexpected acts of God, natural disasters, strikes and other obstacles beyond the Seller’s control. The method of delivery of the goods is determined by the buyer when completing the order, and the Seller offers the following options:

(a) Within the Czech Republic:

(i) Personal pick up at the Žižkov Freight Railway Station(free),

(ii) FEDEX (at the Buyer’s expense),

(iii) DHL (at the Buyer’s expense),

(iv)Czech Post Delivery:

1.) The price for sending goods categorized as publications: 199,- Kč incl. DPH

2.) The price for sending goods categorized as posters in protective tubing: 249 - Kč incl. DPH

(b) Abroad:

(i) FEDEX (At the Buyer’s expense),

(ii) DHL (At the Buyer’s expense).

3. Payment for delivery (packaging and post) is subject to the following rules:

(a) FEDEX (At the Buyer’s expense),

(b) DHL (At the Buyer’s expense),

(c) Czech post delivery within the Czech Republic: 199,- Kč incl. DPH (publications, DVDs, etc.),

(d) Czech post delivery within the Czech Republic: 249,- Kč incl. DPH (posters in protective tubing).

8. Warranty Conditions

The warranty conditions for the goods are governed by the Seller’s Complaints Procedure (Article 9 below) and the applicable Czech legislation.

9.  Complaints procedure

1.For all shipments, the Buyer must inspect the items delivered immediately upon receiving them and check for accuracy, completeness and any visible damage caused by shipping. Any defects found must be noted on the delivery note and confirmed by the carrier or they will not be accepted. Other defects found after unpacking the goods must be reported immediately in writing to the Seller by the Buyer.

2. The Buyer’s claims arising from defects in the goods are based on the relevant provisions of the Civil Code of the Czech Republic, taking into account the nature of the purchased goods.

3. Liability for defects and defects covered by the guarantee of quality do not arise if: a) the goods have been demonstrably used contrary to their purpose; and/or b) they have been used inappropriately in relation to their utility or contrary to the purpose for which they were intended; and/or c) they have been subsequently arbitrarily modified, altered or combined with other items not supplied by the Seller. Minor discrepancies in dimensions and color shades, caused in particular by the natural character of the materials used, are also not grounds for complaint. Neither liability for defects nor the guarantee of quality shall apply to wear and tear caused by normal use of the goods.

4. In accordance with the provisions of § 1820 para.1) (j) of the Civil Code, the Buyer is entitled to refer any complaint that has not been resolved to their satisfaction by the Seller to the competent Czech court or Czech Trade Inspection Authority.

10. Governing law, jurisdiction

1. The applicable law is the law of the Czech Republic. The application of the UN Convention on the Contracts for the International Sale of Goods is expressly excluded. In the case of disputes, the competent court for both parties is the District Court for Prague-West or the Municipal Court in Prague. However, the Seller has the right to pursue their claims at the Buyer’s registered office.

2. If any provisions of the GTC conflict with the Civil Code of the Czech Republic, the relevant provisions of the Civil Code shall apply, but the other articles of the GTC shall remain unaffected.

11. Final Provisions

1. Filling out and sending a completed form via the e-shop brings the GTC into effect between the contracting parties and the buyer confirms that they are familiar with their content, agrees to them and accepts them.

2. These General Terms and Conditions came into force on 25 November 2021.
